Recently, Mr. Faraj, argued before a three judge panel of the U.S. Court of Appeals for the D.C. Circuit a unique issue related to the denial of prejudgment interest on a $135,000 judgment. Mr. Faraj appealed the decision of the trial judge who decided that the governing law of the case, Virginia, required the issue to be decided by the jury when she decided not to award prejudgment interest. Mr. Fara j argued that because he requested the jury be instructed on the matter and because both parties did not object when the judge recommended that she decide the issue, Virginia law required the awarding of prejudgment interest.
